$1.3 Million Settlement in Ft. Myers Wrongful Death Negligent Security Case

The Haggard Law Firm’s Douglas McCarron has obtained a $1.3 Million settlement in a wrongful death negligent security case involving the murder of a young father in the Ft. Myers apartment complex where he lived.

On October 6, 2016, at approximately 6 p.m., Geraldo Olvera was walking through the common area of the Cypress Court Apartments when an unidentified person shot and killed him. Olvera was a resident there.

The property, owned and managed by the defendants had a long and extensive history of violent crime and drug offenses. Despite this history, the property had minimal security measures in place. Police records and numerous individuals’ testimony established the repeated violent incidents at the property which included prior shootings and murder. Moreover, testimony described that the manned security guard would regularly drink alcohol and play dominoes when he was supposed to be patrolling. Plaintiff alleged that the defendants were negligent for failing to provide real and competent security, failing to maintain the premises, and failing to implement any security measures that would prevent and deter crime.

At only 22 years of age, Plaintiff passed leaving behind his beloved mother as well as his infant daughter. The impact of Geraldo’s death caused a tremendous loss to his mother and his 4-month old daughter without a father.
