The Haggard Law Firm’s Douglas McCarron and co-counsel Jeffrey Berman of the Berman Law Firm have obtained a $1.4 Million settlement in a Negligent Security case where the victim suffered a catastrophic injury after he was shot at a gas station. Per the settlement agreement, some details of the case are confidential.
On October 12th, 2017 at approximately 11:00 p.m., John Doe (The Haggard Law Firm’s client) went to a high school football game with his cousin and a friend. Toward the end of the game, John Doe decided to leave a couple of minutes early so that they could beat the traffic. After pulling out of the parking lot, John Doe traveled north and stopped at the nearby gas station.
John Doe pulled up to a pump and went inside the station to pay for the gas. After making his way back to his car, John Doe, his cousin, and a friend were taking pictures of one another near the pumps. As the kids were taking the pictures, unidentified masked men started shooting. Immediately, John Doe ran. As he ran, John Doe was shot in the back of his left knee. Somehow, John Doe was able to stand and hop into the store, before finally collapsing. John Doe was rushed to Jackson Memorial Ryder Trauma Center where he was immediately taken into surgery.
For years, and at the time of the incident, the gas station property had limited and ineffective security measures. The customers at the pumps, as well as those entering and leaving the convenience store were unknowingly putting themselves in danger due to the lack of security at the gas station. At only 20 years of age, John Doe suffered multiple injuries to his knee and lower extremity which required multiple surgeries and finally a knee fusion. These injuries will cause a significant amount of pain and suffering as well as life-altering medical issues.
