The infant child was under his mother’s care when he walked out of the opened front door of his apartment and walked to the back of the property towards a retention pond. Eventually, the infant boy entered the pond and drowned.
Approximately ten to fifteen minutes later, law enforcement located the boy in the pond, but he already passed away. The Haggard Law Firm’s case on behalf of the victim focused on the steepness of the ground surrounding the retention pond, which was allegedly in violation of applicable aquatic codes, as well as other industry standards that Haggard and Finkel alleged the property owner violated. The wrongful death claim settled for $2.35 Million Dollars with the property owner.
