2017 Top Verdict in a Negligent Security Case – Haggard Law Firm

The $12 million verdict obtained by Haggard Law in Machado v Waves of Hialeah was named by TopVerdict as the number one inadequate security (negligent security) verdict and third highest premises liability verdict in Florida in 2017. The negligent security, wrongful death case was litigated by our Christopher Marlowe, Jason Brenner, James Blecke and co-counsel Alexis Izquierdo, ESQ.

The Machado case was also named one of the Top 50 Verdicts overall in Florida in 2017.

This is the second straight year Haggard Law has earned the #1 Inadequate Security verdict recognition. In 2016, Brenner and trial attorney Douglas McCarron were recognized for the $1.7 million verdict obtained in Navas V Regal  Entertainment Group. That case involved injuries suffered by a Monica Navas after moviegoers trampled her while trying to frantically escape a theater after a suspicious person started a fight days after the Aurora Colorado movie theater mass shooting.

Christopher Marlowe and trial attorney Pedro Echarte were the litigators of the #3 ranked inadequate security case on the 2017 list. The pair delivered a $1 million result in Gilbert v. Cryptical Development LLC.

$907K Verdict in Waffle House Parking Lot Beating Case

Late Friday, a Ft. Myers jury awarded long haul trucker Steve Long $907, 211 for the injuries he sustained from a 2014 beating by several people in the parking lot of a Waffle House.

The Haggard Law Firm’s Todd Michaels co-counseled the negligent security case along with Dave Mishael of the Law Offices of David B. Mishael and Steven N. Kassner  of Steven N. Kassner, PA.

The team of attorneys explained to the jury that for the 3 years before Long was attacked on April 19, 2014, , there were 24 significant crimes committed on the property. Those crimes included multiple fights (one involving nearly 100 people) and three incidents involving gun shots.

Haggard Law’s Todd Michaels explains “all of the crime and danger occurred in the 3rd shift, nonetheless, there was nothing done about it, IE: no security in the parking lot, no outside security cameras, poor lighting and no manned security.”

Michaels Delivers Seminar to International Security Organization

The Haggard Law Firm’s Todd Michaels was a featured speaker yesterday at the ASIS International’s 2017 63rd Annual Seminar and Exhibits in Dallas. ASIS is a global community of security practitioners that represent every security-based industry in the public and private sectors.

 

Michaels seminar, “How to Avoid a $100,000,000 Verdict Against Your Business”, was focused on helping security professionals understand how a security plan will not only prevent incidents but also provide a framework for defending a business’s reasonable actions.  Michaels shared his insight on how to avoid a catastrophic lawsuit and used a variety of real-world examples of some of the many notable negligent security case results successfully litigated by The Haggard Law Firm.

Del Rio Apartment Complex Owners Ignored Multiple Requests from Staff to Increase Security

 Tampa – The companies that once owned the Avesta Del Rio Apartment Complex have agreed to pay the family of 23-year-old murder victim Damian Bowie $1.8 million to settle a negligent security lawsuit.  The lawsuit filed by Douglas McCarron of The Haggard Law Firm (www.haggardlawfirm.com) alleged that the deadly 2014 shooting that claimed Bowie’s life could have been prevented if complex ownership took action after multiple requests by staff members to better secure the property.

On March 2, 2014, Bowie visited the Del Rio apartments (5013 E. Sligh Avenue, Tampa) to spend time with friends before going to pick up his son Damian Jr. But, shortly before 4 p.m. that day, the father of three was assaulted, shot and killed on the property.

 “Through the course of our investigation, which included testimony by the defendant’s property manager, it was clear that the employees at the property were pleading for more security and consistently telling upper management how people’s lives were are risk. Instead of acting responsibly, the defendant simply turned a blind eye” said McCarron.

The lawsuit against 5013 Sligh LLC and Avesta Homes on behalf of the victim’s mother and his three children Damian Jr. (5), Damion (3) and Sincere (2 – born two months after his father was killed), alleged the property’s owners knew the area and property were considered high crime areas. McCarron adds, “unfortunately their inaction allowed this tragedy to occur and now three young boys will never see their father again.”

The lawsuit highlights:

  • Testimony from a property manager and documented crime statistics that confirm the complex and area that surrounds is a high crime area.
  • An email sent by Kerrie Richardson, property manager of the complex at the time of the shooting,  to the Hillsborough County Sheriff’s Department requesting an off duty police officer (sent six months before the murder) because of the amount of crime
  • An email from Richardson to corporate for directions on what to do with a tenant that asked for termination of their lease after they were robbed at gunpoint and had their car broken into in just three months.
  • A request by Richardson to property owners asking for expanded security for daytime hours. Bowie was murdered at 4 p.m.

The victim’s family members hope new attention on this case will help police. No one has been charged in the crime.

It should be noted that the defendants in this case currently do NOT own the Avesta Del Rio Complex.
