$6 Million Settlement in Monroe County Wrongful Death and Personal Injury Case

The Haggard Law Firm’s Adam Finkel and Michael Haggard obtained a $6 Million policy limit, pre-suit settlement in a negligent security wrongful death and personal injury case, involving a shooting near a boat dock in the Florida Keys.

On Monday, June 15, 2020, Jose “Pepe” Clemente returned from a hard day’s work at sea onboard a fishing boat that docked in Safe Harbor – a property owned by the Bernstein Trust and operated by Fishbusterz, a local retail fish merchant. As was the custom, Pepe hung around after work to share a few drinks with friends and play dominoes.

That Monday, between 4 and 5:00 p.m., Pepe was hanging out near some lobster traps in the middle of the property, drinking vodka and socializing with other fishermen, including Iliecer “Amarillo” Noa. At one point, two unknown men (not fishermen) approached and yelled towards Amarillo about the whereabouts of another local fisherman. After Amarillo stated that he was unaware of the person’s whereabouts, an argument ensued. Gunshots followed, and Pepe was killed. Amarillo suffered severe injuries, as well, and was represented by The Mustell Law Firm as co-counsel.

$4.2 Million Settlement in Wrongful Death Negligent Security Case

The Haggard Law Firm’s Pedro Echarte and Co-Counsel Michael Flanagan of Flanagan & Bodenheimer have obtained a $4.2 Million settlement in a negligent security wrongful death case in Broward County, Florida.

On December 8, 2018, Dwight Higgins was shot and killed at the Lauderhill Point Apartments (f/k/a Driftwood). That evening Mr. Higgins went to the apartment complex with a friend to visit his friend’s girlfriend. Sometime after they arrived, his friend left the complex and Mr. Higgins was outside in the common areas. Four armed assailants approached him in a robbery attempt. Mr. Higgins tried to run away from the assailants. The attackers began shooting at him while chasing Higgins throughout the complex. The 27-year old was shot and was later pronounced dead shortly after arriving at the hospital.

$1.75 Million Settlement in Duval County Negligent Security Case

The Haggard Law Firm’s Douglas McCarron has obtained a $1.75 Million settlement in a negligent security case involving the murder of a teenager at a Duval County, Florida apartment complex. Per terms of the settlement, the names of the plaintiff, defendants, and defense attorneys cannot be released.

On January 31^st, 2019 at approximately 8:00 p.m., John Doe (the Plaintiff) and a friend arrived at ABC Apartment Complex (the Defendant) to make a quick stop to visit a friend on his birthday. Doe was with his friend in the parking lot of the complex when the friend went to meet another person in the courtyard of the property. After a few minutes, Doe walked toward the courtyard when multiple shots rang out. The victim was struck in the head and rushed to Memorial Hospital where he later died of his injuries. To date, no arrests have been made and there is no indication from law enforcement that suspects have been developed.

$2 Million Settlement in Negligent Security Case Against Security Company

29-Year-Old Kemoze Chambers was killed at an Orlando-area apartment complex

The Haggard Law Firm’s Adam Finkel and Michael Haggard have obtained a $ 2 Million policy limit settlement in a negligent security wrongful death case in central Florida.

Late in the evening of August 23, 2019, 29-year-old Kemoze Chambers was inside his apartment, in Orlando, Florida when an unknown person(s) broke inside and murdered him.

The Defendant in this case Asset Overwatch Services, was contracted to provide private security services to the apartment complex where Kemoze lived. Boasting as a premier private security firm in Florida, Asset Overwatch provided vehicle patrols during its nightly security duties and provided the property owners and managers with nightly shift reports detailing their observations and actions taken.

Negligent Security Case: $3.85 Million Settlement

The Haggard Law Firm’s Pedro Echarte and Michael Haggard have obtained a $3.85 Million settlement in a negligent security wrongful death case. The victim in this case was shot and killed in a drive-by shooting while entering an apartment complex.

The name of the Plaintiff, Haggard Law’s client, is confidential. The Plaintiff was the Personal Representative of the victim’s estate, who brought the case on behalf of the victim’s two surviving parents.

This was a difficult liability case as the shooting was a drive-by and occurred on a public road. Although the victim was entering the property where he lived when he was shot, the defendants were going to argue, inter alia, that the shooting was not preventable as it did not occur on the property.

Stoneman Douglas High School mass shooting brings some peace to the families, friends, and our community impacted by the tragedy on Valentine’s Day 2018. This killer, and any person or entity that contributed to this tragedy by inaction or negligence, should suffer the maximum consequences allowable by the law.

$1.6 Million Settlement in Wrongful Death Case Where Victim Was Shot By Friend

The Haggard Law Firm’s Todd Michaels has obtained a $1.6 million settlement in a confidential wrongful death negligent security case.

The decedent was a talented and good-natured 19-year-old who enjoyed an exceptionally close relationship with his mother. Michaels says this case was a peculiar, difficult, and incredibly tragic case. “What made this case uniquely challenging is that the victim was shot accidentally by a childhood friend.”

$1 Million Pre-Suit Settlement in Gas Station Murder Case

The Haggard Law Firm’s Michael Haggard and Adam Finkel have obtained a $1 Million pre-suit settlement in a negligent security wrongful death case against a gas station operator.

On July 15, 2020, just before midnight 20-year-old Zion Lamar was shot and killed at a Solo gas station in Pompano Beach. Zion lived nearby with his girlfriend and was sent to purchase snacks but never returned home.

Precisely what transpired is unknown as the owner of the gas station did not install functioning surveillance cameras, nor did the clerk respond to audible commotion occurring on the property. Although there is a cell phone video of Zion writhing on the ground, he died shortly thereafter and there is no known eyewitness testimony. It is believed that an altercation occurred outside involving several people, during which Zion was shot.

This settlement was reached after The Haggard Law Firm presented its position regarding the clear liability in this case and the damages associated with the death of a young man. While the defense could not contest the staggering history of daily drug dealing, public intoxication, and violence at the gas station, the defense contested the Plaintiff’s description of the damages in the case.

$5 Million Pre-Suit Settlement Obtained for Father of 4 Paralyzed in Shooting

Miami, FL – The Haggard Law Firm’s Michael Haggard and Adam Finkel have obtained a $5 Million pre-suit settlement in a negligent security case involving the catastrophic injury suffered by a father of four who was with his children when he was shot outside his home.

On December 20, 2019, 33-year old Paul Barry-Austin returned home from a long day of work. It was a nice day so his wife was enjoying the weather outside with their children. The day drastically turned when she noticed a few unknown men roaming the Alhambra Cove Apartment complex’s parking lot. She noticed the men more than once, roaming suspiciously, and expressed concern to Paul. Worried for the safety of his family and aware that the property owners and managers did nothing to prevent or curtail the many burglaries, car thefts, and assaults on the property, Paul walked through the parking lot to make sure the men were not near his home. Soon after, Paul’s wife heard gunshots, and Paul was found lying in the parking lot in a puddle of blood. He had been shot in the back—likely by the very criminals that roamed the property.

$2 Million Dram Shop Settlement in Case Involving Death of a Police Officer Who Was a Young Father

The Haggard Law Firm’s Michael Haggard and Adam Finkel together with Michael Davis of Boone & Davis, obtained a $2 Million total settlement in a dram shop case that involved the death of a police officer.

On February 16, 2019, Curtis Woolwine went out drinking in Broward County. He began the evening at Billy’s Tavern (Happy Hour, LLC) a bar that his wife’s family-owned. After leaving Billy’s, at around 11:40 p.m., Woolwine stumbled into Round Up Country, continued drinking, and was ultimately thrown out for acting inappropriately towards women. It is believed that Woolwine was trying to drive home when he ended up traveling in the wrong direction on Interstate 75. Tragically, he crashed his car into Steven Greco a Miccosukee police officer on his way home from work. They both died. Steven is survived by his wife, Phoebe, and their daughter, Gianna.
