$1.25 Million Settlement in Wrongful Death Case Involving County Bus and Motorcycle

The Haggard Law Firm’s Douglas McCarron has obtained a $1.25 Million settlement in an automobile crash wrongful death involving a Miami-Dade County bus. Because the case was against a count(a sovereign immunity case), it was necessary to file a Claims Bill in the Florida Legislature to finalize the settlement.

Most Plaintiff law firms shy away from sovereign immunity cases due to the statutory caps of $200,000 or $300,000.  The Haggard Law Firm takes these cases and routinely lobbies the Florida legislature successfully to pass claims bills such as the Sanchez case

On May 13th, 2019, Jason Sanchez was riding his motorcycle to work at approximately 7:49 a.m. He was traveling north on SW 107th Avenue in Miami-Dade County, Florida.  As Mr. Sanchez approached the intersection of SW 107th Avenue and SW 176th Street, a Miami-Dade County Bus ran a clearly marked stop sign and entered the intersection.  The bus driver drove the bus directly into the path of Mr. Sanchez, violating Mr. Sanchez’s right-of-way.  Sanchez couldn’t avoid the bus. He crashed his motorcycle and died. The police investigation of the tragic accident showed that the bus driver was completely at fault.

VERDICT: $3.5 Million Result in Car Crash Case Involving a Ride Share Vehicle.

The Haggard Law Firm’s Kimberly Wald and Michael Haggard obtained a $3.5 Million Verdict from a Miami-Dade County Jury in an auto crash injury case.

Olivia Oney was in a car crash where she was the restrained back-seated passenger in an Uber.  Uber provided underinsured/uninsured motorist coverage through Progressive Insurance Company to Olivia. Progressive was the Defendant in the lawsuit.

$9 Million Settlement – Catastrophic Injury Car Crash Case

The Haggard Law Firm’s Pedro Echarte and co-counsel Angel Diaz of Kirshner, Groff & Diaz have obtained a $9,000,000 settlement in a catastrophic injury car crash case.

On March 12, 2021, Defendant Luis Iraheta traveled on vacation to Florida with a friend. Mr. Iraheta rented a Lamborghini Urus from Co-Defendant GoExotics.

That evening, Mr. Iraheta and his friend went to several nightclubs until they ended up at a nightclub in North Miami called the Arena Grill & Lounge. Echarte and Diaz’s client, Abraham, worked security at the nightclub.

Settlement in Haggard Law Firm Trucking Crash Injury Case

The Haggard Law Firm’s Douglas McCarron has obtained a $675,000 settlement in a trucking crash case in Miami-Dade County involving a tractor-trailer and an automobile.

On October 15th, 2020, The Haggard Law Firm’s client, Adrian Huet, exited State Road 826 onto the NW 25th Street ramp and came to a stop at the red light.  Mr. Huet was positioned in the inner left turn lane.  After the left turn signal turned green, Mr. Huet proceeded into the intersection to go west on NW 25th Street.  As Mr. Huet traversed the intersection, JTL Transport driver Jose Abalo-Borrell, who was travelling east on NW 25 Street, ran the red light and caused a violent collision.

$1 Million Pre-Suit Settlement in Trucking Crash Injury Case

The Haggard Law Firm’s Douglas McCarron, along with co-counsel Jorge Rodriguez of the Law Office of Jorge A. Rodriguez, has obtained a $1 Million pre-suit settlement in a trucking crash case involving a critically injured pedestrian.

On March 5th, 2020, Masguel Machado, a driver for DHC Trucking, was stopped at the traffic signal located at the intersection of NW 17th Avenue and NW 18th Street in Miami, Florida.  The intersection is located in a highly traversed area that has a number of businesses surrounding it.  Pedestrians crossing the street to and from these businesses is common. 

Shortly before the incident, Haggard Law client Manuel Anduray attempted to cross the street from the west side of NW 17th Avenue.  This intersection had a crosswalk at the intersection, but no “Walk/Do not Walk” signals.

While the 63-year-old was crossing, the traffic signal changed from red to green.  Moments later Machado ran him over causing Anduray catastrophic injuries to his leg, spine, arm, and head.

Navigating The Road Construction Case

In today’s day and age, road construction is everywhere. It causes frustration and traffic jams throughout South Florida. More importantly, the road construction causes confusion for motorists on how they are to traverse a construction zone.

When analyzing an auto case, it is extremely important to determine if road construction played a hand in the accident. Investigating and taking photographs and video of the scene is crucial. Road construction projects change on a daily basis, so it is imperative to get photographs/video of the scene as soon as practicable.

Depending on the severity of the accident and the injuries involved, the police may document the scene. Many times, even in smaller accidents, construction personnel take photographs or otherwise document the scene. Nevertheless, it is critical that no stone go unturned in trying to locate photographs and video of the accident site. Look for red-light cameras and business surveillance equipment in the area of an accident and make sure to send subpoenas or spoliation letters.

Generally, road construction projects are funded by either the state or county government. As such, the project plans and documentation are public records. Within the plans, you will find a plethora of information such as the identity of the general contractor, the subcontractors, the construction engineering and inspection firm and the daily progress reports. Most importantly, the documents will enable you to identify the entity that was responsible for the maintenance of traffic , or MOTs, for the project.

DBR Features $1.57 Million Verdict Earned in Car Crash Case

Today the Daily Business Review published a feature (in the online edition) on the recent $1.57 Million verdict in a personal injury car crash case. Haggard Law trial attorneys Douglas McCarron and Pedro Echarte litigated the case involving the injuries suffered by clients John Paul Souza and Anh Pham Souza that stemmed from a car crash on Miami Beach in 2014.

The article dives into the primary obstacle McCarron and Echarte managed during the trial to come to the very successful result.

The Souzas are avid travelers who posted photographs on social media of luxury trips to the Hamptons, Bahamas, Necker Island and other destinations. That pastime would complicate the litigation, as defense attorneys pointed to the posts as proof John Souza was unscathed after the Miami accident.

“There were a lot of pictures. [The defendants] were trying to make a big deal out of it,” McCarron said. “A lot of times in these kinds of cases, there’s a lot on social media. It’s not something to be afraid of, as long as your clients are being honest.”

REPORT: Some Uber Drivers Work Dangerous Shifts

A recent story from USA Today lays out how some Uber drivers work dangerously long shifts to maximize revenue. The article written by USA Today‘s Dinana Kruzman reads in part:

For some Uber drivers, long shifts have become the norm.  Dropping fares and profitable incentives lure them to keep driving past safe limits. Because the ride-hailing service doesn’t set a cap on how many hours its drivers can work at a time, there are few legal ways to stop them. By contrast, rival Lyft shuts off its app, which drivers need to find customers, after 14 hours at a time and doesn’t let drivers back on for six hours to let them rest. As a result, the potential danger for Uber passengers and drivers alike continues to grow, even as efforts to limit driving hours spring up across the country.
